Types of L-1 Visas
There are two main types of L-1 visas:

- It can also be used to open a new U.S. office.
- Validity: Up to 1 year for a new office, or up to 3 years initially for existing offices. Extensions available for up to 7 years total.
2. L-1B Visa (Specialized Knowledge Employees)
- For employees with advanced knowledge of the company’s proprietary products, services, or procedures.
- Typically used when transferring technical staff or experts within niche roles.
- Validity: Up to 3 years, with extensions for a total of 5 years.
Who Qualifies for an L-1 Visa?
To qualify for either the L-1A or L-1B visa, both the employer and the employee must meet specific requirements:
For the Employer:
- Must have a qualifying relationship between the U.S. entity and the foreign entity (e.g., parent company, subsidiary, affiliate, or branch).
- Must be actively doing business in both countries during the transfer.
For the Employee:
- Must have worked full-time for the foreign company for at least one continuous year in the past 3 years.
- Must be transferring to the U.S. to work in either an executive/managerial role (L-1A) or in a specialized knowledge role (L-1B).
- The new position in the U.S. must mirror the nature and seniority of the overseas role.
Can You Use an L-1 to Open a New U.S. Office?
Yes, L-1A visas can be used to open a new office in the U.S., which is especially useful for expanding your business presence. However, the requirements are stricter:
- The company must show that it has secured physical office space.
- A detailed business plan must demonstrate the financial viability and planned organizational structure.
- Within one year, the company must support the role of a true executive or manager, not just a startup founder wearing multiple hats.
Can Your Family Join You?
Yes. Spouses and unmarried children under 21 are eligible for L-2 visas.
Even better: spouses of L-1 visa holders can apply for work authorization in the U.S., giving your family greater financial stability and flexibility.
What Documents Are Needed?
To build a strong L-1 petition, be prepared to provide:
- Company documentation proving the corporate relationship (e.g., incorporation certificates, stock ledgers)
- Organizational charts
- Detailed job descriptions for the foreign and U.S. roles
- Proof of employment history (pay slips, contracts)
- Lease or business license for U.S. office (if new)
- Business plan (especially for new offices)
- Tax returns, invoices, and payroll records (for active businesses)
